Q: does is have the flex waist?

No, there is no flex in the waist, whatsoever. These pants are not stretchy, flexible, nor forgiving.

Q: Are these amazon branded? i ordered a pair and received haggar "cool 18 performance" pants. the only thing that stretches is the waistband.

The pair I received are tagged Amazon Essentials. For the record, I really like the Amazon Essentials golf pants and shorts. A great value for the money!
